Use of Services

You may use our services only for lawful purposes and in ways that do not disrupt family collaboration, service reliability, or security. We provide family-oriented tools — including the Recipe & Memory Book — to help households preserve and share recipes, photos, and stories.

Eligibility and Children's Use

Our services are intended for users of all ages. If you are under 13, you should only use the services with involvement from a parent or guardian. By using the services, you represent that you have the legal capacity to agree to these Terms, or that a parent or guardian has reviewed and accepted them on your behalf. Household accounts are managed under adult responsibility.

Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. You agree to provide accurate and complete information when creating or updating your account, keep your contact details current, and notify us promptly if you believe your account has been compromised or if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the services or other users.

Acceptable Use

You agree not to:

• Use the services for any unlawful purpose or in violation of applicable laws.
• Upload, post, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Upload content you do not have the right to share, including copyrighted material owned by others without permission.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Send spam, unsolicited messages, or automated requests that burden our systems.
• Attempt to gain unauthorized access to accounts, systems, or data, probe or scan for vulnerabilities, or interfere with the proper operation of the services.
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law.
• Use the services to distribute malware or engage in phishing or fraud.

We may investigate suspected violations and cooperate with law enforcement where required.

Content Ownership and License

You retain ownership of the recipes, photos, stories, and other content you submit ("Your Content"). You are responsible for Your Content and for having the rights to submit it.

By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and distribute it only as needed to operate, maintain, secure, and improve the services. This license lasts until Your Content is deleted from our systems, except for limited copies we must retain for legal, security, or backup purposes.

We do not claim ownership of Your Content. We may remove or restrict content that violates these Terms, applicable law, or third-party rights, or that we reasonably believe poses a risk to the services or other users.

Recipe share links and public memories

Household members may create time-limited share links so people outside the household can view a recipe without signing in. A share link exposes the full recipe (including ingredients, steps, and notes). Family memories are included on share pages only when a member with permission to edit memories turns on “Visible on share link” for that memory. Opted-in memories show the contributor's display name and memory content to anyone with the link.

You are responsible for what you opt into public share views and for sharing links only with people you trust. Share links can be revoked or expire. Deleted recipes and memories are kept in household trash for up to 30 days before permanent deletion.

Copyright and DMCA

We respect intellectual property rights. If you believe content on our services infringes your copyright, please contact us at contact@gerrardfamily.com with: (1) identification of the copyrighted work; (2) identification of the material you believe is infringing and where it appears; (3) your contact information; (4) a statement of good-faith belief that the use is not authorized; and (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We may remove or disable access to allegedly infringing material and, where appropriate, terminate repeat infringers.

Termination

You may stop using the services at any time. We may suspend or terminate your access to the services, with or without prior notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or if we discontinue the services. Upon termination, your right to use the services ends immediately. Sections that by their nature should survive — including content licenses, disclaimers, limitations of liability, indemnification, and governing law — will continue to apply.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gerrard Family Ventures LLC, its members, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the services, or your violation of these Terms or applicable law.

Availability and Changes to These Terms

We may update, pause, or discontinue features at any time, and we may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the effective date above. When practicable, we will also notify registered users by email or in-app notice. Continued use after the effective date of revised Terms constitutes acceptance. If you do not agree, stop using the services.

Warranty Disclaimer and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE PRESERVED WITHOUT LOSS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Gerrard Family Ventures LLC AND ITS MEMBERS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Governing Law

These Terms are governed by the laws of Utah, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the services will be brought in the state or federal courts located in Utah, and you consent to their jurisdiction.

Payments, Subscriptions, and Billing

We offer a free tier (supported by advertising) and optional premium subscriptions for advanced features in the Recipe & Memory Book and related tools. All paid features are powered by Stripe as our secure payment processor.

By subscribing, you agree to pay the fees for the plan and billing interval (monthly or annual) you select at checkout. Subscriptions automatically renew at the end of each billing period unless cancelled in advance through your account settings or the Stripe customer portal.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain full access to premium features until the end of the paid period. No prorated refunds are provided for partial periods or unused time, except where required by applicable law or at our sole discretion for billing errors.

Payment authorization. You authorize Stripe (on our behalf) to charge your provided payment method for all fees due. You are responsible for keeping valid payment information on file. Failed or declined payments may result in temporary or permanent loss of premium access after reasonable notification attempts.

Pricing changes. We may adjust subscription prices or introduce new plans with at least 30 days' advance notice posted in your account or by email. Continued use after the effective date of a price change constitutes acceptance.

Taxes. You are solely responsible for any applicable sales tax, VAT, GST, or other taxes imposed by your jurisdiction on subscription fees. Where we have a legal obligation (e.g., Utah sales tax nexus), we may collect and remit tax at checkout.

Refunds and disputes. Refunds are generally not available except as required by law (such as certain consumer cooling-off rights) or for proven billing mistakes on our part. Contact us promptly at contact@gerrardfamily.com for any billing issues. Excessive chargebacks or disputes may result in account review or termination of access.

Stripe terms. Payment processing is also subject to Stripe's Terms of Service and Privacy Policy (stripe.com). By completing a purchase you agree to those terms as they apply to the transaction.

All billing and subscription management is handled through Stripe-hosted interfaces for security and compliance. We maintain records of transactions for accounting, tax, and legal purposes in accordance with our Privacy Policy.
